Disruptive Technology and Disruptive Law: Understanding the Law in a New Technologies scenario

Abstract The article deals with the correlation between New Technologies (disruptive) and Law (which should also be disruptive), bringing a proposal for decision making on social complexities in a post-hyper-trans-modern era. The scientific paradigm of complexity, which is explicit as a measure of risk, has developed a paradigm for complexity, which has made explicit the deregulation process, developed problem management strategies, generated risks and generated new technologies. The work is sought to understand the law and technologies Information and information technologies for social enterprises, focused on the response to problems, risks and the possibilities brought about by disruptive technological phenomena. The relevance of the discussion lies in the fact that the impacts of new technologies have a direct impact on human existence in its psyche and techné, unveiling itself through social complexities, and demanding a disruptive right that becomes fundamental for the prevention and management of risks generated technological phenomena.
