This paper intends to investigate whether the partisan position of mayor would have some influence on the probability of conviction in a process driven by diversion of public funds. Have been used data concerning to the 851 districts of Minas Gerais between 2000 and 2008. The information on convictions mayors were obtained by the author through several official and public sources, like the courts, public prosecution and courts of accounts. To estimate the models, we used the Linear Probability Model (MPL), Probit and Logit.
