Abstract M. A. Pegas’ Allegation on the succession of the Captaincy of Pernambuco (1671) probably is one of the best examples of the entanglements among general and particular juridical orders, legal doctrine and courts’ decisions during the Early Modern in Portuguese America. From that book, this paper will discuss the relations among ius commune and the juridical space of Colonial Brazil, which cannot be seen as something apart of the general order.
